O2Micro's Trade Secret Judgment and Patent Invalidation Entered Against MPS

SANTA CLARA, Calif. & GEORGE TOWN, Grand Cayman--(BUSINESS WIRE)--Nov. 11, 2005--O2Micro® International Limited (NASDAQ:OIIM - News), a leading supplier of innovative power management, and security components and systems for the Computer, Consumer, Industrial, and Communications markets, announced today that judgment has been entered in its lawsuit against Monolithic Power Systems, Inc. ("MPS") in the United States District Court in Oakland, California, following trial in June and July of this year.

In a written order entered on November 10, 2005, the Court rejected a challenge by MPS to the jury verdict finding that the asserted claims of MPS' '814 and '881 patents are invalid and are not infringed by O2Micro, and entered judgment in favor of O2Micro on MPS' patent claims. In addition, the Court affirmed the jury's finding that MPS used O2Micro's trade secrets and awarded $900,000 to O2Micro in reasonable royalty damages for MPS' misappropriation of those trade secrets.

The court also awarded O2Micro enhanced damages of $1.8 million -- the maximum allowable amount of punitive damages in light of the reasonable royalty award -- based in part on the jury's finding that MPS' misappropriation was willful and malicious. The jury's award of unjust enrichment damages was set aside, however. O2Micro expects that MPS will file further post-trial motions with the Court challenging the judgment. MPS may also appeal the case to the U.S. Court of Appeals for the Federal Circuit.
